Forensic Accounting - Contract Dispute
We reviewed aircraft charter agreements, vendor invoices, bank records, and other source documentation in order to prepare an accounting of the amount owed between the owner of the aircrafts and a charter company. We also prepared loss profits computation in order to compute the amount the charter company would have earned through the expiration of the charter agreements. Our expert report and jury-trial testimony aided our client receiving an award for unpaid fees and lost profits from the jury.

Corporate Whistleblower Investigation
We conducted an investigation into allegations outlined in a whistleblower letter sent to the audit committee. Several issues were investigated including "tone at the top", personal use of company aircraft, travel and entertainment expenses, segment reporting and deferred compensation distributions. Procedures performed included performing analyses on accounting records, conducting interviews of key company personnel, as well as imaging computers as part of a larger process to review e-mail correspondence and other computer files. The results of our investigation resulted in the termination of three key executive level employees, and a host of recommendations regarding the implementation of stricter internal control procedures.

Determined lost profit damages relating to alleged physical damage at an architectural firm's location as the result of certain construction activities performed by the client. Analysis included the construction of detailed regression equations to counteract the fundamental basis of the opposing expert's opinion.

Constructed economic model to determine and calculate a terminated employee's total lost income as the result of alleged wrongful termination. Project consisted of reviewing historical employment documents, analysis of empirical labor and other governmental economic data, and deposition testimony in order to project individual's probable career earnings.

Alleged Employee Fraud
Our client suspected an employee was committing fraudulent acts concerning accounts receivables. We worked with outside counsel to determine if fraud was taking place and identify how it was occurring. We identified both the source of the fraud and the extent of our client's losses. Our fraud investigators and forensic accountants determined how the fraud was perpetuated and concealed. We issued an expert report, prepared trial exhibits and testified at a jury trial. As a direct result of our work and testimony, the jury ruled that the employee was liable for the damages.

We identified and calculated preferential transfers though development of a sophisticated model, taking into account "new value" and "ordinary course of business" defenses, for over $3 million in payments from over 270 vendors of a 39-store mattress retailer.

Alleged Vendor Fraud
We investigated over fifty technology contractors for vendor fraud, including kickbacks, over-billing, breach of contract and nonperformance for one of the largest public education entities in the nation. The investigation included tracing transactions through accounting records and source documents, interviewing management of the vendors and reporting the results of our findings to the entity's General Counsel.
